These Terms & Conditions (“Terms”) apply to 008media.com and to services provided by 008 Media (“008 Media,” “we,” “us,” or “our”).
1. Agreement to These Terms
By using 008media.com (the “Site”) or engaging 008 Media for services, you agree to these Terms & Conditions. If you engage us for a project, your written proposal or Scope of Work (“Scope of Work”) also applies; if it conflicts with these Terms, the Scope of Work controls for that project.
2. Our Services
008 Media provides creative media, marketing, and digital services, including website design and development, hosting and care, social media management, SEO and local visibility, digital signage content, video, and related services. The exact services, deliverables, allowances, and timeline for each client are set out in the Scope of Work.
3. Quotes, Pricing, and Payment
- Prices on the Site are starting points. Final pricing is confirmed in your written Scope of Work.
- Website builds start with a 50% deposit.
- Work outside your plan’s scope starts only after a written change order, at $150 per hour or a fixed quote.
- Every plan lists what it includes (for example pages, revision rounds, posts, platforms, videos, integrations, and edit hours). Unused allowances don’t roll over. A revision round is one combined list of changes, sent together.
- Advertising spend is paid by you, directly to the ad platform, and is not part of our fees. Third-party costs such as domains, advertising spend, and stock media are billed separately unless your Scope of Work includes them.
4. One-Time Websites and Monthly Subscriptions
One-time website. You pay once for your website build. Once it is paid in full, the website files and design are yours. Hosting & Care (hosting, security and software updates, backups, routine maintenance, and your plan’s monthly edit hours) is billed separately, monthly or yearly.
Monthly subscription. Your website build, hosting, and care are included in one monthly subscription. The website is hosted and maintained by 008 Media while your subscription is active. If the subscription is cancelled or unpaid, the site is taken offline. Month-to-month has no long-term commitment and includes a one-time setup fee. A 3-, 6-, or 12-month term is your commitment for that period, billed monthly at the lower rate, with no setup fee. Social media management is monthly only.
5. Timelines and Results
Timelines depend on the scope of work (typically up to 30 days) and on receiving your content, approvals, and access on time. We don’t promise turnaround times, and we don’t guarantee rankings, reach, followers, leads, or other marketing results.
6. Client Content and Responsibilities
You keep ownership of the logos, text, photos, video, data, and other materials you give us (“Client Content”). You grant 008 Media a non-exclusive license to use Client Content only to provide the services. You confirm that you have the rights to Client Content and that it does not infringe anyone’s rights or break any law, and you are responsible for the accuracy of information on your website and in your marketing.
7. Intellectual Property
The Site and its content, including the 008 Media name, logos, design, graphics, video, digital collaborator characters, and text, belong to 008 Media or its licensors and may not be copied or reused without our written permission. For client projects, ownership of deliverables passes to you as described in Section 4 and your Scope of Work once paid in full. We keep ownership of our pre-existing tools, templates, code libraries, and know-how, and you receive the license needed to use them as part of your deliverables. Third-party items such as stock media, fonts, plugins, and licensed music remain subject to their own licenses. Unless you tell us otherwise in writing, we may show completed work in our portfolio.
8. Third-Party Services
Our services may rely on third-party platforms (for example hosting providers, social networks, ad platforms, and Google Business Profile). We are not responsible for their availability, policy changes, account decisions, or fees.
9. Acceptable Use of the Site
You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping it in bulk, or using it for any unlawful purpose.
10. Text Messages
If you opt in to text messages, our SMS Policy applies. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out, HELP for help.
11. Disclaimers
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, 008 Media disclaims all warranties not expressly stated in a Scope of Work, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, 008 Media will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities. Our total liability for any claim relating to the Site or our services is limited to the amount you paid 008 Media for the services giving rise to the claim in the three months before the claim arose. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to defend and indemnify 008 Media against claims arising from your Client Content, your use of the deliverables, or your breach of these Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before filing a claim, each party agrees to try in good faith to resolve the dispute informally by contacting the other in writing. If it is not resolved, it will be brought in a court of competent jurisdiction in California.
15. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Changes do not affect a signed Scope of Work unless both parties agree in writing.
